Auto accidents and the resulting injuries

Mark Perenich | Clearwater Injury lawyer

While injuries from car accidents are not uncommon, and thousands of people every year deal with severe injuries from car accidents and other transportation accidents. While every car accident is different, there are nevertheless certain similarities and common injuries that result from these accidents, and certain treatments that can work wonders for people who have been affected by these accidents.

Injuries from Car Accidentscar accident

Injuries from car accidents typically include many different types of head or neck injuries, including concussions or whiplash. Whiplash is created by the passenger or driver of the car having their body thrown in one direction while their head and neck snap back in another direction at great force. Similarly, concussions occur when the brain slams into the skull at a high rate of speed after a crash or other transportation issue that injures a person.

Other accidents and injuries involving cars include lower back, neck, and upper chest and back pain (including, but not limited to the ribs, and other areas of the chest, back, and sternum), which are all typically caused by the seated position a driver or passenger is in at the time of a car crash, combined with their collision with the car’s doors, wheel, or seats.

Treatments Abound For Car Accident Injuries

First and foremost, for people in car accidents, it is critical that treatment is undertaken with a medical doctor or team of medical professionals. Treatment could be the healing of broken bones, repair of torn tendons or ligaments, and other medical procedures like X-rays, MRIs, and CAT scans to ensure no serious damage has been undertaken, or, that damage is treated professionally and with the help of good, solid medicine.

From there, treatment can branch out into physical therapy work to repair bones, ligaments, joints, or even movements like walking and talking, depending on the severity of the car accident or injury sustained. Other treatments can include the use of a chiropractor to treat general neck and back discomfort, as well as to optimize the immune system and leave the patient in question in much better shape after the car accident than they had been previously.

Other treatments may include things like medications prescribed by doctors, from painkillers and muscle relaxers, to more serious medications involving therapeutic drugs that can calm a patient after a particularly gruesome or horrifying car accident. These medications can quickly and permanently help a patient overcome the physical and psychological issues in treatment after a car accident, and provide them the opportunity to recover fully no matter the situation.

All in all, car accidents can be difficult things to overcome, but for people who are concerned with their development after one, and passionate about their treatment, it is possible to overcome a car accident and move forward with life. While it takes hard work and tutelage and monitoring by medical professionals, you can overcome and treat car accident injuries and issues and live a healthy, happy life going forward.

School shootings and our second amendment

Injury Lawyer Mark Perenich on the Second Amendment

Today in Newtown Connecticut  there was a shooting at an Elementary school, official numbers are not in yet, but currently the death toll is at 27.  And just 4 days ago there was a shooting in an Oregon mall, 3 people died.  At times like these many people ask me about our second amendment, why we have it, and is it still necessary.  Well what does the second amendment say exactly?

Gun

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

We have to consider the time in which this was written. At this time the United States was trying to free itself from tyranny.  In order words we wanted to have some sort of ability to defend ourself from another country.   The rationale, one could argue, is that if every citizen owned a firearm or gun, invading forces would be less likely to come into peoples homes and they would be better equipped to defend their land.  Moreover since the advent of gunpowder combat has transformed from close hand-to-hand to long range warfare.  But differently, how can one defend their home, family, or property when those taking it have superior weapons?

The issue we face today is: well where is this tyrant?  Some argue that our government is tyrannical, other argue that Russia or China could invade and citizens would need to defend their land.  A different argument is that we need guns for self-defense.  We cannot always rely on law enforcement to be at the right place at the right time.  Gun proponents go onto say that guns are an equalizing force.  Mean that a small weaker person could adequately defend themselves against a larger stronger person with a gun.  Furthermore the person wielding a firearm can and may protect others with it.  The question becomes, are guns being use to protect, or are their more gun accidents?

The bottom line is that the United States is not getting rid of the second amendement anytime soon, so we ought to provide better gun training for everyone.

What is injury law?

Do you need an injury lawyer?

The truth is that bad things can happen to anyone at anytime, not that you needed me to tell you that. There are some mistakes that people make that do have consequences that flow from that event. Some of these mistakes can lead to court appearances and heavy fines added in. If you get to this point, it may be a good idea to talk to an attorney and find out your rights. It is always better to have someone else on your side when you get into a bind, the other party has an attorney, so should you.

There are a few methods people use to find a good lawyer.

One can simply look in the yellow pages (which no one uses) or the inter-webs for a listing of the local attorneys in your area. You can call around until you find one that is willing to listen and help you with your situation. Alternatively one can find a good firm through referrals. One can ask around for some good advice from people that have used one before. This is usually a good way to get help with this kind of need.

Quick tip: Go to the Florida Bar’s website and check to make sure your lawyer is in good standing with bar: http://www.floridabar.org/names.nsf/MESearchDK?OpenForm

There are lots of reasons why someone may need to hire an attorney. It can be anything from a simple traffic violation to more serious things like assault or theft. Whatever the reasons may be, you should find an attorney that only handles certain kinds of law. For some attorneys they will specialize in a specific part. This is always going to be the best way to go when you are trying to get the best possible representation.

Many times people may find that they need to have a family matter or real estate matter taken care of through the court system. When this happens, it is going to be required that you get an attorney to help you settle the matter. If you are trying to get something resolved in court, you need to have the proper representation so that you have a fighting chance. I know people that have resolved personal injury claims by themselves, and they may get say $40,000. However, with proper representation they may have received $400,000.00

In some states you must hire an attorney before you purchase or sell a home. You will find it necessary to have an attorney handle some of the paperwork, although this is not the case in Florida. It is just the normal formality things that they have to settle. It is a lot easier on you when you find someone that is an expert in their field so you will avoid future problems. You will have a better time at getting everything handled in a timely manner.

Depending on the state and they type of case, an attorney will require a retainer be paid up front before they perform any service, or before they begin make themselves available. This is usually a few hundred dollars, although some lawyers will barter for something. It covers some of the up front costs so that they can get started on fighting your case. This is a formality so you should make sure that you could afford the attorney before you decide to choose them.

Here at Perenich Caulfield Avril Noyes (formally Perenich and Carroll) we do not always take retainers, we work of a contingency. Which means we do not get paid unless we win your case! This also means that if you decide whether you want to settle your case or if you want to go to trial. However, be advised that going to trial may mean that you will not receive any money or compensation. It’s unfortunate, but this happens to people that have weak cases.

The Central Park 5 a miscarriage of Justice: when politics overwhelm the justice system

Tampa injury Lawyer | Mark Perenich

I would like to start off by saying I am not a criminal defense attorney, I have exclusively practiced injury law for almost 30 years.  However, I am familiar with the criminal justice system and I can recognize injustice when I see it.  When someone tells me that their rights have been violated, I listen closely and I will do everything I can to help them.  The Central Park 5 story is the type of people I will do anything to help.  It is a very tragic story:

April 19, 1989 jogger was found beaten and raped in Central park. The jogger was a 28 year old investment banker Trisha Meili.  Meili was nearly dead when she was found, doctors expected her to die or to remain in a coma for the years to come.  She suffered serious injuries: severe hypthermia, blood loss, internal bleeding, multiple lacerations.  Meili has no recollection or memory of the event.  5 male juvenile (4 black 1 hispanic) were tried and convicted of the crime.  All 5 confessed (4 signed a written confession the other was verbal), because they were coerced into confessing to the crimes.  The police told them that they had a lot of incriminating evidence, even though they did not .  The kids felt a lot of pressure to confess due to hours of interrogation, this was why the Supreme Court ruled the way it did in Miranda vArizona, 384 U.S. 436 (1966), to make sure that the accused were not exposed to undue duress.  12 years later in 2002 the convictions were vacated after a serial rapist admitted to assaulting and raping Meili, and the DNA evidence tied him to the scene.

While this documentary may be cause people to lose faith in the criminal justice system, we have to be reminded that this is why prosecutors must prove their case “beyond a reasonable doubt”, which means that jurors must be 99% sure that they are convicting the proper people.  This is perhaps why Casey Anthony was not convicted.  In short, our justice system is not perfect, but it has improved and it will continue to improve, unfortunately we should not expect perfection.
